Date
9 April 2026
Judge
A. Christoforou
Counsel
Ms K. Koupari (for Applicant) · Ms A. Papadopoulou (for Respondents)
Legal issues
  • Constitutionality of the Asylum Service's decision rejecting the application for international protection.
  • Whether the Applicant meets the criteria to be recognised as a refugee as a member of a particular social group at risk.
  • The significance and extent of medical examination in substantiating the risk.
Facts

The Applicant, a national of the Democratic Republic of the Congo, entered the Republic of Cyprus in 2019 and applied for international protection. The Asylum Service rejected the application.

Reasoning

The Court held that the Applicant is a member of a particular social group at substantiated risk of persecution. The Asylum Service's rejection was not sufficiently reasoned.
